But speaking on Radio 4 yesterday, Stephens said: "One of the problems that we have is that effectively what we have got now is a watershed moment. So the rich and famous with children are now going to be able to put forward these saccharine images and the preened images by their spin doctors to the public and the public won't be able to have them gainsaid by the free press in the United Kingdom.
 
"Celebrities used to say they feared blackmail, often without merit, and they got privacy injunctions often on the back of that. That no longer works following the case involving John Terry [when the News of the World revealed his extra-marital affair in 2010].
 
"Now what we are seeing is children thrown under the legal bus in order to prevent stories coming out.
 
"It seems to me not without notice that one of the judges was a family law judge and therefore brought that perspective of the children…
 
"The message that goes out to celebrities is that if you are going to have a manage a trois or open relationship make sure you have children because you'll be able to keep it from the public."
 
The injunction means that publication or individual who reveals the identity of the married celebrity at the centre of this story in the UK would be guilty of a criminal offence. But it is not in force overseas.
 
In the United States the 1st Amendment right to freedom of speech generally trumps privacy and for an injunction to be enforceable there is must be served on the person or company seeking to be restrained.
 
Meanwhile, the Daily Mail front page today said: "WHY THE LAW IS AN ASS!".
 
It goes into detail about how a privacy injunction which bans publication in the UK has not stopped a story about a high-profile celebrity's extra-marital affairs being written about in the US and widely discussed on social media.
