The Independent on Sunday is to pay libel damages to a soap actor after using a file picture which wasn’t identified as being posed by a model.
Harry Capehorn, who has appeared in Family Affairs, is expected to receive a public apology from the paper in court on Tuesday (18 July).
Capehorn’s picture was used to illustrate a front page story in April headlined: “The Asbo kids”.
According to Capehorn’s lawyers, David Price Solicitors and Advocates: “It was not made clear in the article that the photograph had been posed by Mr Capehorn as a model. Accordingly readers could have understood that Mr Capehorn had in fact been issued with an Asbo, when he has not.”
The paper is to pay Capehorn “an appropriate sum in compensation”.
